Hydrate Diamonds & Watches – Terms and Conditions
Please read these Terms and Conditions (the “Conditions of Sale”) carefully before placing an order on www.shophydrate.com (the “Website”).
By placing an order on the Website, you agree to these Conditions of Sale. These terms only apply to orders placed through the Website and do not apply to sales through other channels.
I. Updates to the Conditions of Sale
We may update these Conditions of Sale from time to time. The latest version will always be available on the Website. Any updates take effect immediately upon posting. Changes made after you place an order will not affect that order, except as required by law.
II. Purchasing Eligibility
As a dealer in precious metals, stones, and jewelry, Hydrate Diamonds & Watches and its affiliated entities comply with U.S. Bank Secrecy Act (BSA) and FinCEN regulations. We reserve the right to refuse sale to any customer who does not meet internal compliance requirements.
By ordering from the Website, you confirm that you are a bona fide end-user purchasing for personal use and not for resale or distribution.
III. Product Availability & Quantity
- All orders are subject to product availability and acceptance by us.
- Some products may not be immediately available. Contact Customer Service for more information.
- Quantity limits may apply. We reserve the right to refuse or cancel any order or portion of an order at any time without notice.
IV. Prices, Taxes & Shipping Costs
- Prices listed on the Website exclude sales tax, shipping, and other applicable taxes unless stated otherwise.
- Taxes vary depending on the shipping destination.
- Prices and shipping costs are subject to change without notice.
- In rare cases of pricing errors, we may contact you to correct the order. If we cannot reach you, we reserve the right to cancel the order and refund any payments made.
V. Shipping & Delivery
- We only ship to addresses within the United States. We do not ship internationally.
- We do not ship to PO boxes for security reasons, but PO boxes are acceptable for billing.
- Shipping Options:
- USPS Priority Mail (orders under $50): $15
- FedEx 2-Day Express: $45
- Free shipping on orders over $500
- Delivery times are estimates: allow 2–3 business days for Priority Mail. Items ordered together may ship separately.
- Confirmation of Order & Shipment will be emailed and constitutes acceptance of your order.
- Delivery requires a signature. If the recipient is someone other than you, their signature confirms delivery and transfer of responsibility. We may request ID verification at delivery.
- Delivery may be delayed due to events outside our control (e.g., weather, carrier issues). If delivery exceeds 30 days from confirmation, you may contact Customer Service to cancel the order and receive a refund for undelivered items.
VI. Payment
- Accepted payment methods are listed during checkout.
- We may require additional verification or identification to authorize your payment.
- By ordering, you authorize us to perform security checks and transmit/receive information to validate your identity and payment.
- We do not sell to individuals or entities on the OFAC SDN List or to sanctioned countries. Transactions will be declined if this applies.
VII. Returns & Exchanges
- Hydrate Diamonds & Watches sincerely hopes that you will be satisfied with any Product(s) you purchase from us. However, given that all of our Products, whether Shop Products or Custom Products, take several days to weeks or even months to create, we do not offer any returns or refunds for any Products you purchase.
- In the unusual event that you receive a Product that arrives damaged, you must notify us immediately by emailing info@shophydrate.com.
- Such notice must be sent no later than twenty-four (24) hours after you receive delivery and must include your name, email address, and a picture along with a written description of the damaged Product. You must also return the damaged Product to us at the address provided at your cost. We will discard and will not respond to any damage notice that does not comply with these requirements.
- If your damage notice does comply with these requirements, we will then forward the matter to our insurance provider, VAAX Shipping Inc. If the insurance claim is accepted, then upon such notice from VAAX Shipping Inc, we will notify you via email, at which point we will commence production of a replacement Product to send to you free of charge.
VIII. Repairs & Services
- We offer professional jewelry cleaning, resizing, polishing, and repairs.
- Repairs from non-authorized providers may not be serviced.
- Repair requests may incur charges if outside warranty coverage.
- Hydrate Diamonds & Watches may retain replaced parts, unless local law requires return.
IX. Limitation of Liability
- Our liability for any order, whether in contract, tort, or otherwise, shall not exceed 100% of the price paid for the product(s).
- Certain exclusions may not apply in some jurisdictions due to local consumer protection laws.
X. General Provisions
- If any provision is deemed invalid or unenforceable, the remainder of the terms remains effective.
- These Conditions of Sale constitute the entire agreement between you and us for orders placed through the Website.
- Waiving a breach does not waive future breaches.
XI. Arbitration & Dispute Resolution
- Any dispute shall be resolved via binding arbitration under AAA rules, except eligible small claims may be filed in court.
- You waive your right to a jury trial and class-action claims.
- Arbitration will occur either in your state or Shelby County, Memphis, TN.
- 30-day pre-notice: Before arbitration, you must notify us and attempt to resolve the dispute amicably for 30 days.
XII. Governing Law
- Governed by Federal Arbitration Act and Tennessee law, without conflict-of-law references.
- We may pursue legal proceedings in your country if allowed by law.
XIII. Security & Privacy
- We implement reasonable technical and organizational measures to protect your data.
- Protect your account credentials and devices. We are not responsible for compromised passwords or unauthorized account activity.
- Personal information is stored only as long as necessary to fulfill the purposes collected, then securely destroyed or anonymized.
- Third-party data collection is governed by their respective privacy policies.
